Pocahontas Grand Jury Indictments Handed Down For April 2011 Term

Marlinton, WV – Eleven individuals have been indicted on a total of 18 counts; 10 felonies and 8 misdemeanors after the April 2011 session of the Pocahontas County Grand Jury, according to Prosecuting Attorney Donna M. Price.

George Sewell, of Marlinton, is indicted on two felony counts, one for Grand Larceny and one for Transfer of Stolen Goods, accused of stealing construction tile from Tygarts Valley Construction Company.

Travis Brown, of Arbovale, is indicted on one felony count of Domestic Battery, 3rd offense. Brown has two previous convictions for domestic battery in Pocahontas Magistrate court in 2006 and 2008.

Julia Hale, of Frank, is indicted on one felony count of Driving Under the Influence, 3rd offense.

Rodney Swearingen, II, of Hillsboro, is indicted on one felony count, Driving Under the Influence, 3rd offence, and three misdemeanors; driving after his license was revoked for driving under influence, possession of less than 15 grams of Marijuana, and attempting to flee in his vehicle from law enforcement.

John Brewer, of Bartow, is indicted on one felony count of Failure to Register as a Sex Offender.

Phillip C. Dean, Jr, of Marlinton, is indicted on one felony count of Child Abuse Resulting in Injury, and one misdemeanor count of Contributing to the Delinquency of a Minor.

William Cassell, of Buckeye, is indicted on one felony count of Wanton Endangerment, and two misdemeanor counts, one for Domestic Battery, the other for Domestic Assault.

Herbert McClure, of Marlinton, is indicted on one felony count of Driving Under the Influence, 3rd Offense. He’s also indicted on one misdemeanor count of Driving with a license Revoked for Driving Under the Influence.

Greg C. Sharp, of Cass, is indicted on one felony count of Fleeing while Driving Under the Influence, and one misdemeanor count of Driving Under the Influence.

Earlin Puffenbarger, of Marlinton, is indicted on one felony count of Failure to Register as a Sex Offender.

Carla L. Johnson, of Hillsboro, is indicted on one felony count of Delivery of a Schedule II Controlled Substance, to-wit, Oxycodone 30mg tablets.

An indictment means that the Grand Jury has determined there is enough evidence to proceed to trial. All those charged are presumed innocent until proven otherwise in court.
