Pocahontas Grand Jury Returns Over Seventy Indictments During August Session

Marlinton, WV – The Pocahontas County Grand Jury returned 68 felony and 3 misdemeanor indictments against 19 people after the August 11th session before Circuit Court Judges James J. Rowe and Joseph C. Pomponio, Jr.

Roger W. Teter, Jr., age 37, of Buckeye, faces one felony count of altering a registration plate. Teter is accused of affixing a 2011 decal on his license plate with glue. The license had expired in November, 2009.

Jean M. McCarty , age 48, of Marlinton, faces one felony count of child abuse. She is accused of whipping a child with a stick at least 10 times because the child was attempting to play music on the computer while doing chores.

Shirley A. Turner, age 25, of Marlinton, faces one felony count of burglary, and one misdemeanor count of battery. She is accused of unlawfully entering the home of Jean McCarty and of repeatedly striking McCarty in the face.

Donald R. Hoke, age 51, of Marlinton, faces two felony counts – one for grand larceny, and one for receiving or transferring stolen property. He also faces two misdemeanor counts for providing false information and obstructing an officer. Hoke is accused of being involved in the theft of boxes of 20×20 tile, valued at over $5200.00. He is further accused of providing false information to and obstructing the investigating officer.

Christopher P. Grimes, age 38, of Gas City, Indiana, faces one felony count of burglary. He is accused of entering a private residence near Marlinton with the intent to commit a crime.

Timothy P. McGinn, age 51, of Slatyfork, faces one felony count of manufacture and possession with intent to manufacture or deliver a controlled substance. McGinn is accused of being in possession of 39 Marijuana plants.

Douglas O. Trent, age 53, of Summersville, WV, faces one felony count of delivery of a controlled substance. The controlled substance in question is Methamphetamine.

Timothy Lee Queen, age 24, of Bartow, faces two felony related to a scheduled III controlled substance – one for possession and the other for delivery. The controlled substance in this case is Hydrocodone.

Wayne Allen Cool, age 50, of Bartow, faces four felony counts, one for prohibited person in possession of a firearm, one for delivery of a schedule III controlled substance, and 2 counts for possession with intent to deliver. Cool has a previous conviction for domestic violence and as such is prohibited from being in possession of a firearm – he is accused of being in possession of a .22 caliber rifle. The second count is for Hydrocodone, the remaining 2 counts are for possession of Cocaine.

Lacy A Biggs, age 31, of Marlinton, faces three felony counts of sexual abuse by a Guardian or custodian or person in trust to a child. Biggs is accused of having sexual contact with 2 boys below the age of 10 during the period from October 2010 and January 2011.

Harley F. Dickinson, age 26, of Huntington, WV, faces four felony counts – count one for possession of schedule III controlled substance, count two for possession of a schedule I controlled substance, count three for manufacture, possession with intent to manufacture a controlled substance and count four for prohibited person in possession of a firearm. The controlled substances are Hydrocodone, Cocaine and Marijuana, respectively. The fourth count stems from a previous conviction for breaking and entering.

Janet L. Lang, age 37, of Valley Head, WV, faces one felony count of embezzlement, and 19 felony counts of falsifying accounts. Lang is accused of embezzling funds from the Route 66 Outpost retail store. She is also accused of altering the daily sales sheets in order to obtain money to which she was not entitled.

Phillip Wayne Shinaberry, age 20, of Cass, faces three felony counts – one for breaking and entering, one for conspiring, and one for transfer/receiving stolen property. Shinaberry is accused of breaking into a private business near Marlinton, conspiring with someone else to commit a crime, then transferring or receiving stolen goods.

Joshua D. Kincaid, age 25, of Marlinton, faces two felony counts – one for grand larceny and the other for receiving or transferring stolen property. Kincaid is accused of being involved in the same theft as Donald R. Hoke.

Elmer Lee Tincher, III, age 29, of Marlinton, faces one felony count of burglary. He is accused of entering a private residence near Marlinton with the intention to commit a crime.

Ferrell G. Kelly, age 48, of Cass, faces 7 felony counts of uttering, 7 felony counts of forgery, and one felony count of prohibited person in possession of a firearm. Kelly is accused of forging and presenting checks drawn on the account of his father Walter G. Kelly. The 7 checks total almost $930.00 and were made payable to various insurance companies. The firearm felony count stems from Ferrell Kelly’s previous convictions for forgery. He is accused of being in possession of a 20 gauge shotgun.

John Greathouse, age 29, of Bartow, faces two felony counts – one for possession of a schedule III controlled substance, the other for possession of a schedule I controlled substance. Greathouse is accused of possession of Hydrocodone and Marijuana, respectively.

Steven C. Bryant, age 39, of Buckeye, faces two felony counts – one for burglary, the other for sexual assault in the 2nd degree. He is accused on unlawfully entering a private residence in Marlinton with the intent to commit a crime. He is also accused of sexual intercourse or sexual intrusion with another person without their consent.

Randall Bibb, age 57, of Marlinton, faces one felony count of failure to register as a sex offender within 3 days of release of incarceration.

An indictment only means that enough evidence has been presented to convince the Grand Jury that the case should proceed to trial. All those charged are presumed innocent until proven guilty in a court of law.

Heather grew up in the Richmond, Virginia, area and now lives in Arbovale, West Virginia with her husband Chuck. Heather is a wonderful flute player, and choir director for Arbovale UMC.
